Colleteral clause in bills of exchange (Collateral bills)

Pursuant to Article 133 of the Turkish Code of Obligations No. 6098, the bill of exchange is deemed to be regulated for performance unless otherwise agreed. In practice, it is seen that some bills of exchange, which are arranged for collateral purposes, are called collateral securities and that the bills of exchange issued for the sake of direct performance (execution) are mixed with the bills of exchange prepared to establish narrow and technical collateral relation. Regarding the bills of exchange, which are organized for the purpose of securing a narrow and technical guarantee, different views are found in both the precious negotiable instruments law and civil procedure and enforcement-bankruptcy law. The aim of our thesis is; to classify the types of collateral we have defined as commercial bill which establish a narrow and technical collateral relation between basic relations and commercial bill; evaluation of each collateral type in terms of bills and evaluating the conditions under which the evidence regarding the collateral claims can be asserted in the context of different opinions and decisions of the judiciary.
