Abstract (EN)
There are a number of rules that public officials who are responsible for the execution of public services have to comply with. Officials working in the public sector face a number of sanctions as a result of not complying with the positive and negative rules. Disciplinary processes are supervised in various ways. The Ombudsman Institution, which is the subject of this study, is a supervisory body for disciplinary penalties. The institution provides recommendations by examining the actions and transactions of the administrations in terms of human rights, justice and law. The Ombudsman Institution has taken many decisions regarding the actions and transactions of the administrations. In this study, it is aimed to analyze the disciplinary penalties subject to the decisions of the Ombudsman Institution. In this context, the aim of the study is to examine the decisions regarding the disciplinary penalties applied to public officials in the light of the decisions of the Ombudsman Institution. The points that were noted in the relevant decisions, the referenced principles and the attitude of the Ombudsman Institution in general were examined. The study consists of three parts: the disciplinary regime of the civil servants, the examination of the Ombudsman Institution and the disciplinary regime in the decisions of the Ombudsman Institution. In the study, literature review and document analysis were made as a method. In this context, 43 decisions taken by the Ombudsman Institution regarding disciplinary penalties between 2017 and 2022 were analyzed. As a result, it has been understood that the Ombudsman Institution advises the administrations on the axis of good governance principles.
