Disputes in public construction works: Analyzing the solution methods by the help of decisions

Determining and minimizing of the disputes which come out during the application of construction projects, can protect against time and material loss. On this study which was done for this aim, structure and general properties of the construction sector were examined firstly. The position of the sector on the World and in Turkiye was observed and the general problems of the sector were mentioned. After this, the construction sector was taken up on the side of law and international laws. On public projects, the reasons and the resolutions of the disputes by ?Formal Dispute Resolution? and ?Alternative Dispute Resolution=ADR? were mentioned.In application part, the decisions which were taken by various institutions (Exchequer and Audit Department, Supreme Court, Council of State, High Science Committee etc.) and which were determined at previous chapters about the main disputes (time of work, prices, allowances, acceptances, delay costs) in building of public constructions were evaluated according to different criterions. Finally, at the end of the observations, it has been seen that the decision is 57% in favour of administration, 29% in favour of contractor and 14% independent results.
