Abstract (EN)

The state benefits from public power in order to regulate the components and meet the needs along with the deaths in social life. This power emerged through the public officials subordinate to him. The stated use of public power by a public official in the performance of his/her duty may vary depending on real or false criminal charges. In order to protect the public official against unreal crimes that he may be exposed to, our legal system has subjected the public official to different procedures than the procedures that apply to the trial performance of the public official. There are also some crimes for which the protein cannot benefit from the protection of a public official. What exactly this public official is, who is considered a public official, the criminal liability of the public official, and the procedures regarding the investigation of the penalty will be explained in basic terms. In the following, bribery, embezzlement and extortion crimes will be explained in terms of intent, legal elements, malfunction, formation forms, establishment status, active transaction status and investigations, as they are crimes specific to public officials and are detailed with public administration. In this study, what exactly the concept of public official is, who is considered a public official, the criminal liability of the public official, and the procedures regarding criminal investigation will be discussed in basic terms. In the following, the crimes of bribery, embezzlement and extortion will be explained in terms of intent, legal elements, perpetrator status, forms of formation, state of attempt, state of effective regret and investigation procedures, as they are crimes specific to public officials and are closely related to public administration. In the study, a general explanation will be made using sample judicial decisions, especially the Supreme Court Decisions, and the justifications of the law to understand the purpose of the legislator, in order to provide practical information.
