Kâzarûnî's risâla of Bay' bi-al-wafâ: Critical edition and analysis

The work, which the researcher has examined its analysis and critical edition in this study, titled "Ishārāt ba'ḍ ahl al- wafā' bi-jamʿ aḥkām bay' il-wafā", was written by Afīfuddīn Abd Allāh ibn Ḥasan who lived in Mecca and was known as Kāzarūnī. This work was written as a risāla within Islamic Law corpus. It is significant in terms of being the most comprehensive work on this subject. This study consists of four chapters, excluding the introduction and conclusion. In the preface and introduction, the subject, purpose, scope, method, and sources of the research are mentioned. The first chapter introduces the author of the treatise, the environment he lived in, his scholarly identity, and the historical circumstances. In the second chapter, the author's method and the sources he referred to in his work are addressed, furthermore, the authors of these sources are determined, hence, the work is analyzed through its references. The third chapter defines bay' bi-al-wafā (a contract for sale subject to a right of redemption), its practices, emergence, and the approach of the Meccan scholars of the author's era by referring to Hanafī fiqh literature, particularly, in the treatise of Kāzarūnī and the explanation of how bay' bi-al-wafā took place in the sources of other schools of Islamic Law. Thus, the contribution of the work to literature will be more clearly understood and the claim will be confirmed regarding that it is the most comprehensive work in the literature on the subject while presenting the subjects related to bay' bi-al-wafā and most emphasized until the author's era. In the fourth chapter, a critical edition of the entire manuscript has been performed.
