The tenant's obligation to return of the leased under the lease agreement

Since the main purpose of lease agreement is transferring the right of usage to the tenant, the leased property must be delivered to the tenant by the landlord at the beginning of the agreement. With the termination of the agreement, the tenant's obligation to return the leased property arises. The debt to return the leased property in the lease contract, which is regulated in art. 334 of the TCO, is therefore one of the most important debts due to the termination of the lease agreement. In our study, it is aimed to explain the tenant's debt to return the leased property in general terms of TCO and herein, the issues that related to the terms of evacuation in housing and roofed workplace lease agreements are tried to be explained together with general terms. In this context, first of all the general conditions of return of the leased debt and the scope of it have been examined. In the second chapter the return debt of the tenant has been examined detailedly. In this chapter especially the innovation and change in the leased which is related to return debt has been explained. In the third chapter, which is the last section of our study, the legal liability and the rights of the landlord in case the tenant acts contrary to the debt of return are discussed and the content of the landlord's right to demand has been tried to elucidated.
