Abstract (EN)
Personal rights of all human beings can be violated also by human beings. Violation of personal rights is carried out through different means. One of these tools is the internet. Protective provisions against violations of personal rights are of course also regulated for the violations on the Internet. However, due to the special characteristics of the internet environment, special protective provisions have been enacted against violations in the internet environment. One of these protective provisions is the provisions regarding the blocking of access to websites and the removal of internet content. These decisions, which we will briefly call the blocking of access and the removal of content, serve as an important protection against violations of personal rights on the Internet. However, there are some deficiencies in the existing regulations that address the fulfillment of this protection function. In this study, the protective provisions of the Law No. 5651, the Turkish Civil Code and the Law on Intellectual and Artistic Works that are related to the violations of personal rights on the internet, the deficiencies we have identified in these provisions and some of our suggestions for the elimination of these deficiencies are discussed.
