Abstract (EN)

Article 10 of the 6698 no. Law on the Protection of Personal Data regulates data controllers' obligation to inform the data subjects. According to Article 10, when the personal data are obtained, the data controller shall enlighten the data subject with all the information that are regulated at Article 10 and Article 11. According to Article 18, if data controller neglects his/her obligation to inform the data subject, he/she is fined to administrative sanction which is 5.000 TL to 100.000TL.The obligation to inform the data subjects has an important place in the protection of personal data law. In the first part of our study, the development of personal data protection law in both international and national law and some of the basic concepts were examined in order to understand better the law. In the second part of our study, the protection of personal data, the principles of obligation to inform the data subjects and the purpose of this obligation within the frame of Turkish law were analyzed. Lastly, the structural elements of the misdemeanor of omission of information obligation were discussed.
