Abstract (EN)

The most significant source of knowledge in religion in 4th and 5th century when the religious sects started to systematize is revelation with a broader expression sem?. Although reason is surely accepted as the source of knowledge in worldly field, the same consensus hasn?t been reached in religious field among the scholars. In this context, whereas some religious sects don?t recognize reason at all, many others allow reason talk even if in different degrees. There has been a controversy among the ones who accepts it in terms of drawing up the hierarchy between the reason and revelation.This tension between reason and revelation is more observed in Islamic Theology. However, since Islamic Theology composes the substructure of Islamic legal theory, this tension observed here reflects to procedure. The procedure, which treats only the acts of people in charge, performs the said discussion primarily in terms of whether the acts were forbidden or free before the divine inspiration and then Case Law and the analysis of judgements. The ones who give priority to reason in getting knowledge defend that reason can make judgements about the acts even without divine inspiration. In addition to this, they reckon a great competency to reason in religious field after sem?i speech. On the other hand, the ones who give priority to divine inspiration in getting knowledge initiate this judgement about the acts with divine inspiration and they leave a limited area to reason as much as possible in religious issues.Hanafite school of law starts with Abu Hanife (150). However, it carries on its evolution in different science centres and with people who have different views of Islamic Theology. The most important ones of these are Baghdad and Transoxiana. In the 4th century, the procedure was systematized by Jassas in Baghdad, where Mutazili influence was dominant. And there is the priority of reason in judgements of acts which are a matter of the procedure. Although the same view was tried to be carried in Transoxiana where Sunni School was influential by Dabusi in 5th century, it was observed that there was a refraction in the views accepting the authority of reason concerned Sunni School.
