Abstract (EN)
In this study, 1228th article of 6102 numbered Turkish Commercial Code and more organized bill of lading was investigated. Bill of lading is an instrument (a deed) having the nature of the most commonly used negotiable instruments in the maritime freight transportation. Broad scope of the bill of lading is due to obligation to examine in terms of negotiable instruments rules and rules of maritime law. The legislator has foreseen the multiple functions presumption that the bill of lading and there are unlimited inscriptions the bill of lading may include, in doctrine, has led to the emergence of multiple comments relating to the nature and the classification of negotiable instruments. In this study, bill of lading was examined in the national and international legislation, doctrine, the light of suprime court's decision and from the perspective of negotiable instruments; the analyzes were brought to the controversial aspects about the bill of lading.
