Determination of rental price in housing and roofed workplace rentals

In our study, we've reviewed the rent restrictions for residences and roofed workplace rents. In this context, although the relevant provisions of the repealed Code of Obligations No. 818 and the Law on Real Estate Rents No. 6570 are mentioned, we have tried to explain how the rental price will be determined by examining the application of the Turkish Code of Obligations No. 6098. Within this scope, Presidential Decree No.85 and the notices established were examined during our practice along with the Supreme Court practices. We examined the subject of our study in four different parts. In the first part, we paid attention to the price element in the lease agreement. We tried focusing on to the meaning of tenancy aggrement and the rental cost, alogn with the tenants ability to cover the debt, the rental cost in terms of the liberty of contract, and the freedom and limitations of the adding rent-increase term to the rental aggrement. In the second part, we examined the Turkish Code of Obligations article 344 and its application within the scope of the determination of the rental price and the principles to be applied. On the other hand in the third part, we went through the meaning and the characateristics of rent declaratory lawsuit due to Turkish Code of Obligation No.345. Finally, the differences between the lease fixation case and the adaptation have been tried to be explained.
