Periods for the determination of the rent in residential and roofed workplace rent

Real and legal persons prefer to purchase or lease to meet their needs for the things they do not meet and immovable things they do not own that align with their needs. A dwelling is where people continue their accommodation and vital activities, and a workplace is where they carry out their economic and professional activities. In order to carry out these activities, people prefer the rental method as it may be more economically advantageous than purchasing. Rental price is an essential element in establishing a lease agreement. In the context of the lease relationship, if the parties do not agree on the price, they may request the court to redetermine the rental price. In our study, the determination of the rental price in residential and roofed workplace leases and the related periods are examined together with a historical process. The law has specially protected the lessee, who is accepted to be in a weaker position in terms of economic and bargaining compared to the lessor. As a result of epidemics, regional and global wars, economic changes, depreciation of the Turkish Lira and exorbitant price increases affecting our country and the world, the problem of rental prices has been further triggered. However, a number of temporary measures and limitations have been introduced. Our study is analyzed in three main sections, excluding the introduction and conclusion sections. In the first part, general information on lease agreements, in the second part, the determination of the rental price and the periods in the residential and roofed workplace lease agreements in Turkish Law, in the third part, the period of filing a lawsuit for the determination of the rental price and the problems encountered with the effect of these periods are examined by supporting the current judicial decisions. In light of these explanations, this study aims to clarify the theoretical and practical aspects of the process in disputes regarding the rental price in terms of residential and roofed workplace leases.
