Legal regulations on global climate change, carbon trading

Climate change, especially experienced in the last centuries and frequently mentioned by different segments, has become an important global problem today. Scientific studies have revealed the seriousness of this problem and made it known all over the world, albeit late. The changing world order and the fact that developing countries prefer the energy they want to obtain by using fossil fuels to the changing climate is the main source of the problem. Resolving this global problem, which concerns all humanity, seems possible with the decisions and steps to be taken by all the countries of the world by coming together. In this study, qualitative research model was adopted, data collection and analysis method were applied, and international conventions, scientific researches, scientific thesis studies, journals, articles, mass media, and online resources were used. In the study, it is aimed to deal with global climate change in a wide scope and which legal regulations and agreements have been made on a global scale to reduce the emission of carbon dioxide gas, which is among the greenhouse gases that cause climate change, to the atmosphere, the applicability of the decisions taken, whether they have positive effects on the climate, especially the Paris Agreement. After the decisions taken in the Resolution, the issues of what kind of legal arrangements should be made to increase the applicability of the carbon trade application on a global scale and in Turkey at the point of reducing carbon emissions were discussed. As a result of the evaluations, although the Paris Agreement is more realistic in terms of applicability compared to the agreements made before it, it does not seem sufficient at the point reached. For this reason, first of all, it is necessary to reconsider the carbon trade application under two separate headings as developed countries and developing countries, and deterrent legal arrangements should be made by the United Nations on a global scale. A clear stance should be taken and a conclusion should be reached in the prevention of climate change, with the aforementioned legal regulations and the application of penal sanctions when necessary. In Turkey, there are no legal practices such as laws, regulations and regulations at the point of carbon trade for the prevention of climate change. In this respect, Turkey should make a legal regulation again under the title of Environmental Law, allow the application of carbon trading and do its part in climate change.
