Abstract (EN)

Compensation Commission of Human Rights or as we prefer to call towards our thesis work Compensation Commission, was founded with the Code No: 6384 after the European Court of Human Rights held in the pilot judgement procedure towards Ümmühan Kaplan v. Turkey and declared that Turkey did not have an effective remedy to redress the violation of the right to have a trial within reasonable time. The Commission is deeply related to right to have a trial within reasonable time and the right to an effective remedy in terms of its structure and scope of duty. This work substantially aims to initially examine the quality, the extent and key elements of rights that is related to the foundation of the Commission in the light of case law of the European Court of Human Rights and then evaluate the effect of the Commission towards the structural problem on account of trials taking excessively long time causing the violation of such rights. The Methodology behind this work is comparing the practice in Turkey with some of the countries that is member of the Council of Europe in the light of case law of the European Court of Human Rights and Constitutional Court of Turkey, detecting the flaws towards the practice and presenting propositions to solve them.
