Özet (EN)

It has become a necessity the judge to apply to experts for the resolution of disputes in social life, which has become complex with the developing technology. In the event that the judges require special or technical knowledge in order to decide on the dispute, the legal regulations have made it possible for the parties to apply to experts in order to support their claims and defenses on the dispute and to enlighten the case, as well as the experts to be appointed by the court. The parties may seek expert opinion before the lawsuit in order to have an idea about the subject matter of the dispute or to see their chances of success in the lawsuit. Expert opinion can also be obtained in order to prepare their petitions or to correct the deficiencies of the expert report received during the case. Thus, the parties will be able to contribute to the court's reaching the truth. In the relevant study, the institution of expert opinion will be examined by comparing it with other institutions. If the expert opinion institution is given the necessary value, the importance of the institution will be emphasized by mentioning the contributions it will provide to the proceedings.
