Abstract (EN)
The subject of the study, the work of Al-Hidayah by Merğinânî, the reasons for the dispute of Hanafi and Shafi'i jurists related to Islamic Family Law were tried to be revealed. Under this chapter, It was determined that there were conflicts between Hanafi and Shafi'i jurisprudents in 75 issues, 32 of which were about marriage contract, 5 about breastfeeding, 34 about divorce and 4 about family law. The study consists of a three parts first introduction and two other chapters that covers previous issues. In the introduction part covers the importance of the study, aim of the study, methodology, literature summary and the life of the author that are briefly introduced. In the first chapter, the conflicts were determined that Hanafi-Shafi'i Conflicts on Marriage and breastfeeding; In the second chapter reveals disputes that are related to the 'Divisions and Divorce and Family law related to the criminal offenses', with the help of other Hanafi and Shafi'i tried to uncover the reasons.
