The necessity and proportionality in the context of self defence

The basement of this study is the legal basement of self defence and the elements of necessity and proportionality that are the conditions in relation to defence of self defence. Also the conditions of mistake and exceeding the limit within the context of necessity and proportionality are another parts of this study. In this context in the first chapter; the concept of self defence, its historical development, legal basement and legal character; in the second chapter; the necessity as a basic condition of defence and in the third chapter; the proportionality as the limiting function of the defence and the conditions of mistake and exceeding the limit were examined in detail.
