Abstract (EN)

Abstract: The Effect of Conflicts Between Sects on the Legal Age of Marriage in the Personal Situations Law People differed in understanding the Quran and sunnah. As a result of this, sects including four sects have emerged. The people of each town are based on the opinions of one of these sects in their treatment. Then came the period of legalization of religious provisions and the provisions were arranged in laws. One of these codification titles is the personal circumstances law. The subject of the study; It has been determined as the comparison of the "human laws on marriage" in the personal cases law with the views of the four madhhabs. For this, four countries were determined and the denominations of those countries were taken as a basis. The Libyan law of personal circumstances is compared with the Maliki sect, Egypt is compared with the law of personal circumstances, the Hanafi sect, Jordan's law of personal circumstances is compared with the Shafi sect. The study is divided into two parts and in the first part; The concept of legal dispute, law and their emergence are discussed. In the second part, the issues that the scholars disagree about on the subject were examined and these were compared with the laws of the countries mentioned above. Ten topics were discussed in the study. In each issue, first of all, the points of dispute between the four sects were mentioned separately, then the law article of the countries on the subject was mentioned separately, and finally, the law article of each country and the sectarian view were compared. The study was completed with the conclusion section containing the results reached. The most important of these consequences is the following: It has been observed that sects have an effect on the personal matters law enacted in the countries where they are applied, but this effect did not constitute the most to take the views of other sects in case of interest.
