Abstract (EN)
International arbitration is one of the most preferred dispute resolution methods that parties have often resorted to in recent years. The parties may decide in advance to resolve the potential disputes between them through this method. However, the fact that international arbitration is not a free dispute resolution method may give harm to the parties' rights for access to justice especially to those who have difficulty paying the fee for it. In order to resolve this problem, an idea has recently emerged that a fund can be received from a third party, who is not a party of the dispute. However, this idea leads to discussion on some topics such as confidentiality of arbitration, independence and impartiality of arbitrators, the necessity for showing security for costs and sharing the costs of arbitration.
