The comparison between Gurar'ul-ahkam of Molla Hhusrev and Multaqa of İbrahim Halabi on ‎muamalat chapters (Sales, ijarah, company, agency, transfer of debt, guarantee, pawning)

Ottoman law studies are generally not considered in the context of fiqh texts. Gurar'ul-ahkam ‎and Multaq'al-abhur are called by many Ottoman jurisprudents as "strong text" and became ‎master reference guide. Diversity in the Ottoman juristic texts that applies The Hanafi school ‎includes various juristic opinions and considered as the dimension of the law. ‎ Specially, civil cases of both texts have been compared and the different opinions are ‎determined. In addition, reflection of these various opinions on the Ottoman Judiciary practice ‎were also studied.‎ This study consists of an introduction and two statements and the conclusion. Particularly, in ‎the introduction statement includes, reviews of the subject, importance, aim, hypothesis and ‎literature of this study. The first statement of this study comprises, biography, personality, ‎works of Molla Husrev and Ibrahim Halebi and reviews on Gurer'ul-ahkâm and Mültekâ'l-‎ebhur. In the same statement, general view on the ottoman state and economic situation during ‎fifteenth and sixteenth centuries are briefly explained. In addition to that, jurisprudence and ‎juristical education in the ottoman statement are described. In the second part of this study, ‎Sales, Ijarah, Company, Agency, Transfer of Debt, Guarantee and Pawning charters at ‎different opinions of the same cases are studied. The analys of this study is comprised at the ‎conclusion part.‎
