Abstract (EN)

Optional Liability Insurances for Motor Vehicles are insurances where the liability of the vehicle operator arising from the damage to the third parties because of the operation of the vehicle is guaranteed. What is essentially guaranteed here is the interest of the vehicle operator over the protection of its assets as a whole. The guarantee provided to the vehicle operator by the Optional Liability Insurances for Motor Vehicles is applied when the coverage offered to the vehicle operator by the Highway Motor Vehicles Compulsory Liability Insurance is insufficient. In the case that the compensation claims of the injured third parties exceed the insurance amounts specified in the Highway Motor Vehicles Compulsory Liability Insurance contract, the rest of the amount are covered by the insurer under the Optional Liability Insurances for Motor Vehicles. Therefore, there is a sequential liability in providing coverage for damages between the insurer under the Highway Motor Vehicles Compulsory Liability Insurance and the insurer under the Optional Liability Insurances for Motor Vehicles. Optional Liability Insurances for Motor Vehicles plays a complementary role in terms of risks that are not covered by the coverage of Highway Motor Vehicles Compulsory Liability Insurance. In this study, in the context of the Optional Liability Insurances for Motor Vehicles; the characteristics of liability insurances, the provisions to be applied to liability insurances and the elements of the contract for the Optional Liability Insurances for Motor Vehicles were examined, the obligations of the parties in the contract were emphasized and the controversial issues on the subject were examined.
