Abstract (EN)
The dependency is one of the basic elements of the employment contract and differentiates the employment contract from other types of contracts that are subject to work. However, the concept of dependence has been emptied due to the spread of flexible working styles, the effects of the globalization trend and the tendency of employers to avoid the costs arising from employing workers. From the classical definition of the concept of dependency, it is now seen that, despite the need of an important part of the employees, they do not benefit from the rights and opportunities provided to the employees / dependent workers. For this reason, the concept of dependency must be redefined and readapted according to changing conditions. Although there is not much debate in Turkey, especially in developed countries the contents of dependency and whether the issue of who should be considered as dependent employees has been the subject of intense research. Through identifying the legal status of employees correctly, helps to determine who will benefit from the Labor Law and other provisions of the law protecting the worker and thus to determine the extent of the Labor Law. The main fulcrum of the opinion that the end of the labor law, which has been increasingly expressed in recent years, is the fact that the concept of depen-dency is eroded and emptied. The erosion in the concept of dependency is not a problem only in the field of law; on the contrary, it is the subject of social policy in a narrow and broad sense by the reason of the fact that the majority of the population employed as a dependent employee in industrial societies and is the basis of the relations between the individual and the employer. Based on these facts, the changes in the concept of depen-dence, the factors affecting the change, the solutions to the problems that arise as a result of the change and the effectiveness of these solutions are discussed in this study in detail.
