Exception according the fundamentalists of al-mutakallimun

Usul al-fıkh (jurisprudence) the name of science that consisted in two part fıkıh- juristic and usul – method. And this science aims to reveal judgements according the islamic law using islamic evidences, origins and sources. Books on jurisprudence belongs to very first centuries of İslam. For the being independent field of study, it has been written plenty of books in this field throughout history. And it is being continuing nowadays. Some of this books contain entire jurisprudence. And some contains most specific area. And we prefer the second part for this thesis. İn this books has been considered common conceptions about terminological works that expresses common senses and appropriation methods. But we think that it must been work on some common conceptions presently. And one of this is the term İstisna (exception) which is the most important part of lisaniyat, kelam(kalam) , mantık(logic) fıkıh (jurisprudence) . İn this thesis we tried to consider this term with its all sides especially literally and with the eyes of usul scholars. We can briefly explain this term according usul-al fıkh (jurisprudence) like this. Based on by the one source, containing especial and limited words, being contiguous and not being separate, the general thing from which the exception is made, that is, the antecedent (al-mustasna minhu) which is the part that generally precedes the particle illa/ إلا and like that.
