Özet (EN)
This study defends the thesis that Nietzsche's philosophy contains a conception of law that can offer solution suggestions to contemporary problems in legal philosophy. Throughout history, the issues of law and justice have remained relevant in both life and philosophy. Law and politics have consistently faced crises, and the present age is no exception, we are currently experiencing an enduring crisis in law and politics, with ongoing challenges in law and justice. Therefore, both the law itself and legal philosophy that encompasses law are continuously updated with respect to their concepts and issues. If the gravity of the situation regarding the current legal and political crisis can be sufficiently recognized, it is worth investigating the definitions that an important philosopher like Nietzsche brought to the fundamental concepts of law. Additionally, the concept archeology that he introduced in this field, as well as the potential contribution to legal philosophy through his ideas about these concepts, should be considered. Nietzsche has repeatedly referred to legal concepts such as law, justice, crime, punishment, good, politics and legal code in his texts; He thoroughly examined the origins, history, and genealogy of these concepts. If read carefully enough; Nietzsche defined law many times and determined its place in philosophy. This study aims to explore Nietzsche's perspective on the fundamental concepts of law and legal philosophy by analyzing his own texts, alongside primary and secondary sources in the field of philosophy of law. Its objective is to integrate his conceptual creations into the realm of legal philosophy, uncover his understanding of law through the historical development of legal philosophy, and examine his genealogical approach to investigating the genealogy of law. The primary focus of the thesis is to examine Nietzsche's contribution to legal philosophy and its relevance to contemporary issues. The conclusion drawn is that Nietzsche's contribution represents a novel and unique conception of law.
