Abstract (EN)

Positive damage means the damage suffered or incurred by the creditor due to failure of the debtor to fulfil its contractual obligations at all or properly. The fact that such event occurs frequently in practice has rendered the concept of positive damage much more important. It is required to thoroughly point out the differences of this kind of damage from other types of damages and similar concepts. As part of our study, the differences of the concept of positive damage from other types of damages and more especially from the negative damage have been analyzed; the cases warranting the compensation for the positive damage have been examined; the differences of the concept of positive damage from other similar concepts have been mentioned; each of the components of the positive damage has been analyzed and the particulars related to the computation of the positive damage have been dealt with.
