The circumstances which are not required explicit consent in the process of special categories of personal data

Within in the scope of the legalization processes that started in the 1980s, the consciousness of protection of personal data started to realize itself within the European Union and Organization formations, and the same consciousness has spread to the national laws of the countries. So also the Rebuplic of Turkey who started studies in this context, first stepped in the field of protection of personal data under the contract that it has signed in 1981, then after finally finished its legislative activities and studies about data protection laws by adopting Turkish Personal Data Protection Law no. 6698. In this regard, the special categories of personal data which are issued in Turkish Personal Data Protection Law no. 6698, the regulation of these data in other international regulations, the circumstances which are not required explicit consent in the process of speacial categories of personal data in the context of relevant law no.6698 and international regulations were examined in this thesis. Our thesis consists of three parts. In the first part of our thesis; the emergence of the need for protection of personal data, the concept and the types of personal data and legal regulations related to the protection of personal data; in the second part; the principles of processing of the special categories of personal data and the concept of explicit consent; in the third part, in particular, the circumstances which are not required explicit consent in the process of special categories of personal data were examined.
