Abstract (EN)
The subject of this study is "Interest in the Payment of Pecuniary Debts". Our laws contain the definition of neither the concept of money nor the concept of interest. The legislator leaves this important work to the doctrine. Nevertheless, principal interest rates in Article 88, payment by national currency, and foreign currency debt in Article 99, and default interest rates in Article 120 are regulated in the Turkish Code of Obligations. Issues regarding commercial interests are regulated in Articles 8, 9, and 10 of the Turkish Commercial Code. In the light of these regulations and decisions of the supreme court, in the first section, the concepts of money and pecuniary debt; in the following sections, the concept of interest and controversial issues regarding interest are discussed.
