ixPATENTABILITY REQUIREMENTSSUMMARYInventions which are the products of intellectual ingenuity have a significant effect onthe technological and economic growth of countries. By patent, it?s intended to reward theintellectual ingenuity of the inventor, promote it and ultimately enhance society by thedisclosure of the invention.A patent is a document that legally protects the patentee for a limited period of time.The granting of a patent prevents the infringement of the patentee?s monopoly, protecting himnot only from illegal use of the invention but also from independent inventors of the samething.Having such an important position in intellectual property, a patent is granted withcomprehensive provisions and limitations both in national and international legal systems.Patentability requirements, as it considered to be the subject which should be examinedprimarily and carefully in Patent Law, is therefore the subject of our study. According to ournational Patent Law in the provisions of Decree Law No. 551, the patentability requirementsare settled as novelty, inventive step and industrial applicability just as in the European PatentConvention and other international agreements.In our study, first of all, under the heading of concepts; intellectual property, patent,type of patents, patent right and regulations regarding patents are examined. In order toexamine the patentability requirements, it is essential to determine the meaning of invention.Therefore in the first section, under the title the subject of the patent: invention, concept andtypes of invention are examined.In the second section, application for patent and examination of patent application isinvestigated. The determination of patentability requirements by TPE begins with the patentapplication of the inventor. As well as the procedure for granting national patents, theprocedure for granting European Patents and international patents according to PatentCooperation Treaty are also examined.In the third section, patentability requirements- novelty, inventive step and industrialapplicability are examined in detail, the provisions of international agreements, Decree LawNo. 551 and the changes in Proposed New Patent Act are determined and compared.
