The right to share in joint ownership and limitations of this right

In this study, we have researched the right to share in joint ownership and limitations of this right accordence with the provisions of the Turkish Civil Code and some of the private codes, supported by the decisions of the supreme court. The right to share in joint ownership is a special form of termination of the co-ownership. Because this is kind of a right that can use by any owners without any justification. Although this right is intended to protect individual property, on the other side it should not be overlooked that the co-ownership shouldn't sacrificesed with this purpose. Because in some cases, termination of joint ownership may cause harm to all owners for the time being or in terms the status of the subject of the joint ownership. The purpose of this thesis is to research all the aspects of the right to share ın joint ownership and especially lımıtations of this right.
