Abstract (EN)
The purpose of this study is to evaluate the administrative police power of Turkish Competition Authority over mergers and acquisitions. In this context, this study examines the economic administrative police power and independent regulatory authorities; determines the legal characteristic of the activity that Turkish Competition Authority performs over mergers and acquisitions; and scrutinizes the operation of this activity. This study is performed within the framework of the Law on the Protection of Competition, secondary legislation and the doctrine. This study also benefits from the decisions of Constitutional Court, Council of State and Turkish Competition Authority.
