Informatics crimes in risk society and the effectiveness of law

In 1990s, with the widespread usage of information technologies especially computers and the internet, new categories and ways of committing crimes emerged. These new categories of crimes which were conceptualized as "informatics crimes" are among the risks of the technologies produced by human beings themselves. Ulrich Beck analysizes today's society with "the risk society theory". Beck states that the risks that were formerly caused by nature or supernatural forces are now manufactured by man himself. He expresses that through globalization uncalculated risks affect everyone. In the process of individualization and digitalization in the risk society, human rights protected by law have been transferred to the virtual world. Therefore, from the rights of sexual immunity to honor and dignity, property rights to personal privacy are violated in the virtual world. The secrets of states and companies stored on the internet are at risk. Information technologies are instrumentalized by terrorist organizations as a means of propaganda and communication. In this study, through using document analysis method and research, informatics crimes were examined in the context of the risk society and the effectiveness of positive law formed on the axis of the values of modernism was examined. Beck describes the risk society by giving examples of the dangers of the environment, economy and security. In this study, the risk society is investigated in the context of crimes informatics as a global threat. This very study carries great significance due to its unique nature and contribution to the literature.
