Abstract (EN)
This thesis, that discusses the development of invalidity system from Roman Law to Turkish Law consists of three main chapters. In the first part of the thesis, legal transaction with its components in Roman Law and the freedom of contract principle are primarily being discussed. Later on the related part, some information regarding the terminology of invalidity in Turkish Law and basic concept are given. In the first section of the second part, the stages of invalidity in Roman Law, through historical process, are explained. In the second section, invalidity reasons related to the capacity to have rights and obligations and capacity to act in Roman Law are explained. In the third and last section, the reasons for the invalidity of the legal transaction in Roman Law are investigated and the regulations in the Turkish Law are compared at this phase.
