The problem of the linguistic certainty in Sadr al-Sharīa's legal methodology

The problem about the certainty of the language that Fakhr al-Din al-Rāzī explicitly raises reveals an important problem area related to the methodology of Islamic sciences. This discussion, which is on the axis of language-logic, word-meaning relations, has been expressed as a manifestation of deliberately dealing with the question of how to obtain certain knowledge. In this direction, al-Rāzī pursued the ultimate certainty by making an important and profound methodological criticism. While this effort is an important step in providing certainty of knowledge, the claim that language is not certain jeopardizes the validity of literal evidence that forms the basis of knowledge about Sharīa. Therefore, the opinion that language is far from certainty has been criticized by many scholars. Sadr al-Sharīa who carried this claim to Hanafi legal methodology, was also among these scholars, systematically dealed with the possibility of certainty of language emphasizing over an approach to certainty different from that al-Rāzī suggests. In this context, this study focuses on the background, fundamentals and content of the discussion of the certainty of language within the confine of Sadr al-Sharīa's views and works. The problem, whose theoretical framework was examined in the study, was also studied within the scope of language issues in Islamic legal methodology. Thus, in this study, taking into consideration the basic Hanafi works on legal methodology, the projections of the approach of Sadr al-Sharīa's approach to the problem of certainty of language in the legal methodology were analyzed.
