Abstract (EN)

Title: The Role and Significance of Personal Data in Health Law in the Delivery of Healthcare Services Objective: The aim of our study is to try to create a general concept framework by examining the processes of processing personal data in the provision of health services, to increase the level of knowledge about the personal data of health service providers and individuals benefiting from health services, and to create a written resource. Method: Our study, especially within the framework of the Law No. 6698 on the Protection of Personal Data and the Regulation on Personal Health Data and the provisions of the legislation in the field of health, the decision search page of the Presidency of the Court of Cassation of the Republic of Turkey on the internet and the decisions of the Court of Cassation are discussed in the case law of the European Court of Human Rights through the HUDOC Database. Results: When current legal regulations and professional information are provided, not only the rights of patients are protected, but also the rights of healthcare providers and institutions are protected. Conclusion: In addition to legislative regulations, effective implementation of the rules and raising awareness of patients will strengthen the privacy of personal health data and increase the effectiveness of health services. In this way, individuals' trust in the health sector is strengthened and healthcare professionals can fulfill their duties effectively.
