The ethical aspects of personal data and privacy right in health law

In relation to technological advancements, matters concerning the protection of personnel data have become more pressing. These technological developments are outraging our control over personal data. Specifically, this situation gets rather severe in more sensitive types of personal data that of concerning an individual's health matters. This study consists of three main sections. The first section is mainly dedicated to the subject of personal-private data. In the second section ¬–without gripping ties from personal data –, the aspects concerning right of privacy is examined. And the third (final) section is reserved for the administrative and judicial means to seek action against possible cases of personal data breaching in general terms. In order to specify the terms related to personal data, and to determine the extent of personal data protection more comprehensively, this study is primarily examined in a conceptual basis. Subsequently, the aspects of personal data protection and its direct or indirect connection to specific rights are evaluated. Moreover, the terms and conditions that personal data breaching become possible is explained. In the second section, specifically the day-to-day privacy infringements that people face both during state of health and treatment processes are examined in relation to ethical and legal values. In the third section, application procedures to seek action in cases of such infringements are specified concerning only related aspects due to the immensity of the subject.
