Özet (EN)
The reason for choosing this area is that crime and punishment are as old as human history. Besides, crime and punishment are closely related to the culture of society. Crime and punishment are concepts that have taken place in the history of law literature, along with the life in the form of tribes existence. Our study which we have created by adopting the interdisciplinary method consists of three parts in addition to entrance and entrance. In the introduction part, the development of crime and punishment has been examined in terms of world and Turkish history. Also in this section, Seljuk law has been analyzed. Then, the law enforcement of the Great Seljuks and Anatolian Seljuks against crime and punishment were divided into "Punishment against Reclamation", "Punishment against Body", and "Punishments according to the subjects" and each title was distributed to the other chapters in turn, The law enforcement of Anatolian Seljuk has been examined with examples. How the law of Seljuk was created is a controversial issue. According to some historians, there is no Islamic influence in Seljuk law. According to the others, disregarding the influence of Islam in the Seljuk law is a discourse that will not go beyond ignoring the facts. While we were preparing our thesis, we examined the punishment enforcement applied in the main sources of the Seljuk law in terms of examples. As a result of our investigations, we have hardly encountered the directives of Islamic law in the law enforcement applied in Seljuk. Of course, it should not be forgotten that since the understanding of social history wasn't yet developed in the Middle Ages time period when the Seljuks existed, it is not possible to generalize the Seljuk law because the writing of history was shaped within the lives of big men and there is no sufficient information about how the ordinary people were punished in the sources in Seljuk . This issue will remain a controversy among historians because there is not much source in the literature due to the Mongol army's devastation in Anatolia. Our opinion is that Islamic law was also applied in Seljuk law. I believe that we have done a well-rounded study which can be beneficial even though there are not many sources in history literature for the field of Seljuk law. This study we have done will reach its aim when it makes contributions to the academic world.
