Resolution themes (Applications) for Hanedfi madhhab in Serahsî's Mebsût

Serahsi, one of the most important Hanafi scholars of the fifth century, was born in the city of Serahs in Khorasan. Except for his childhood years, he spent most of his life in the cities of Maveraünnenir, Fergana and Özkent. He wrote many works on usȗl and furu in the field of fikh. He wrote most of his works in prison under impossibilities. The thirty-volume work named Mebsȗt, which he wrote in prison, has an important place in the literature of fikh. As the subject of the thesis, in the example of license provisions in this important work, which deals with all the subjects of furu fikh, license provision in the Hanafi school are discussed. License provisions are temporary provisions that allow the subjects to abandon the original provision depending on the incidental situations (such as necessity and hardship). As a license provision in the work of called Mebsȗt, there have been identified in twenty-three circumstances such as prostating on the back, anointing, praying on the journey, praying in fear, fasting on the journey, not fasting during Ramadan, fasting in case of illness, witnessing that he sees the Ramadan crescent when the sky is cloudy,menstruating woman doing farewell circumambulation of Kaaba, throwing stones three days before dawn in Stoning the devil, entering al-Haram with game animals, plucking grass and cutting thorns in the harem, approaching a woman while in ihram, lost article, selem contract, arâyâ in shopping, reminders to the witness by the judges, having a witness written in the book of the judges, license to use water, in the case of necessity in drinking hamr and eating haram meat, bludgeoning, begging and being content with little. Serahsi analyzed these provisions according to sects and took them with a systematic and philosophical approach. He supported the provisions related to license with verses and hadiths and analyzed the views of the sects in an impartial way.
