Orphan in Ottoman law in the context of the fatwas of Şeyhülislam Ebüssuûd Efendi̇

The terms orphan and orphan are generally used for people who have lost both parents. In this study, a general evaluation and comparison of the fatwas given by Ibn-i Kemal and Ebussuud Efendi, important sheikhs of the 16th century, on "orphanhood" will be made. In the first section; the subject will be evaluated in terms of conceptual framework. First, its literal meaning and origins will be examined. Then, its meaning in literature will be mentioned. The Islamic perspective of the subject will be revealed through verses and hadiths related to orphanhood. In the second section; the fiqh aspect of orphanhood will be evaluated. The historical process of the subject will be discussed from the pre-Islamic period to the present day, and legal and institutional studies on orphanhood in various periods will be examined. In addition, this section will address the attitude and perspective of the society towards orphans throughout the process. In the third section; information will be provided about the lives of Ibn-i Kemal and Ebussuud Efendi, the authors of the fatwas to be evaluated in the research. First, the childhood and youth years will be discussed and then the scientific aspects will be discussed. In the last section, the jurisprudential evaluation and comparison of the fatwas given by Ibn-i Kemal and Ebussuud Efendi on orphanhood will be made.
