Protecting personal data within the context of duty of disclosure in Insurance Law

One of the most important subject is declaration obligation of insurant, in insurance law which is arising from the idea of being safe against to uncertain negative risks. All important information which is known or must known by the insurant and will be affect on willingness to draw up a insurance contract of insurer, must be declared by insurant. It is inevitable that many matters which are included in the scope of declaration obligation are personal data, considering that insurance contracts are shaped within in the context of specific situations of insurants or interests of insurants. Within this framework, it is important that processing lawfully personal data which is declared by insurant. Because, must be accepted that personal data is on the basis of insurance industry and insurance which is isolated from personal data is not possible. Personal data protection law is a fairly new issue for our country and therefore there are very few studies which is examined insurance law and personal data protection law together in doctrine. In first chapter of our thesis study which is organized in four parts, personal data protection law which is a new issue for our country, has been explained, in particular the concept of personal data term and processing of personal data. In the second chapter of our thesis study, the types and parties of the insurance contract were examined and declaration obligation of insurant has been explained in third chapter. In final chapter, inferences have been made follow the instructions of legislations, available studies and decisions of the Personal Data Protection Board in Turkey, by bringing together insurance law and personal data protection law.
