Abstract (EN)
With the brokerage contract, which is widely used in practice, the broker acts as an intermediary to ensure that his client concludes a contract. As a rule, the broker is entitled to a fee when his client concludes an articles of association as a result of his intermediary activity. In the Turkish Code of Obligations, no detailed regulation has been made for the brokerage contract. The reason for this is that the brokerage agreement is a type of the power of attorney agreement and in cases where there is no provision, the provisions of the agency agreement will be applied. In this context, it will be necessary to refer to the provisions regarding the power of attorney in order to determine the rights and obligations of the parties and the termination of the brokerage agreement.
