Abstract (EN)

Appointing a trustee for the management of a company has regulated as a protective measure in article 133 of Criminal Procedure Code No 5271. Appointing a trustee for the management of a company, which is a special type of seizure, is a severe and exceptional protective measure and for this reason, it can be applied in case of only certain conditions exist. In this regard, only in cases where there are strong grounds of suspicion that the crime is being committed within the activities of a company and it is necessary for revealing the factual truth, the judge or the court is entitled to appoint a trustee for the management of a company with the aim of running the business of the company, for the duration of an investigation or prosecution. The crime is being committed within the activities of a company must be one of crimes which stated in the fourth paragraph of article 133 of Turkish Criminal Procedure Code.
