Employer's Obligation for notice in Social Security Relations

The obligation of the employer to give information to the institution has great importance the Social Security Law. Because it is obvious that the person whose social insurant services are not notified, will be effected by this situation throughout his life. From this aspect, the effects in terms of the insured shall be seen in the cases of elderliness and illness. Besides, in case of the death of the insured the effects of the employer's notification can be certainly seen by the beneficiaries. In this study, primarily the obligation of the employer to notify his workplace to the institution and the transport, transfer and inheritance of the workplace and also sub concepts of employer have been discussed; again the employers' obligation to notify the insured employees to the institution and the results of this obligation have been told and the legal and penal sanctions that will be imposed to the employers who employs legal workers without notifying his insured employees to the institution, who underreport the daily earnings taken as basic to premium of the insured or number of days with regard to premium or who make collusion and fictitious notice have been explained. Also the matters that the insured employees whose insured services have not been notified may make a complaint about the employer by applying to the institution in person and they can also use the report lines such as Alo 170 (Labour and Social Security Communication Center) and Alo150 (The Prime Ministry Communication Center BIMER) have been mentioned. Furthermore; the subjects with regard to the fact that the insured whose services have not been notified can litigate and bring an action for fixing of period of service and in consequence of this action they can have their retrospective services regarded and hey can gain the right for severance pay in reply to the number of premium days.
