Creating a criminal organization for the purpose of engaging in criminal activity, managing or becoming a member of such an organization.

Organised crime has been a serious type of crime which survives until today. However, it has become more complicated because of the technological advancement so fight against organised crime gets more difficult at the present time. The acts of creating a criminal organisation for the purpose of engaging in criminal activity, managing the organisation and admitting the organisation were enacted as separate crimes considering the importance of the legal values protected by these crimes although these acts are essentially just preparation activities for the crime. The concept of organised crime, general assessment of the criminal organisations and criminal complicity, history of criminal organisations and first punishment norms about them, also some criminological types of criminal organisations are included in the first part of this thesis. In addition to this, the second part of the thesis involves the crimes of creating or managing the criminal organisation, membership in criminal organisations, non-members? activities of aiding the criminal organisation and making propaganda of these organisations and also effective repentance clauses and sanctions with respect to these crimes. In conclusion, committing crimes on behalf of criminal organisations by non-members, criminal responsibility of the criminal organisations? leaders due to crimes committed on behalf of these organisations, criminal attempt, criminal complicity, concurrence of crimes and other legal regulations about the criminal organisations in Turkish Criminal Law are included in the third and the final part of this thesis.
