The prosecution of the children dragged into crime

The thesis was divided into four sections and in the concept of child took place in the first part. The definitions of the child in the international conventions and in the Turkish Penal Code, the Code of Criminal Procedure and the Law on Child Protection were made. In the second part of the thesis, the investigation phase in the trial of children who were dragged into crime was explained. In the investigation phase, after explaining the criminal responsibility firstly, the characteristics and subjects of the investigation phase were explained. In this section, the reasons for ending the investigation in the juvenile judgment were explained. Among the reasons for ending causes, the decision, which was one of the most important decision of the public prosecutor and recently took place our practice, of there is no spot for investigation was addressed. The importance of this decision and requirement of its implementation were emphasized. Another decision of the public prosecutor was mentioned in detail in the decision to postpone the opening of the public case and it was mentioned that this was the decision which should be implemented but not implemented in practice. In the second chapter, the social examination report was explained in detail and the importance of receiving this report was emphasized especially in juvenile judgment. In the third part of our dissertation, the prosecution phase in children's trial was mentioned extensively. The characteristics of the prosecution phase in children's trial, the subjects and the reasons that ended this phase were elaborated in detail. In this section, it was emphasized that the hearing of children and adults should be done separately. In the fourth part of our thesis, the legal ways in the children's trial were explained. The legal ways were divided into two parts as ordinary and extraordinary, taking place in extraordinary legal ways because of that the usual legal ways didn't include, the individual application way to the constitutional court was explained in detail within the thesis.
