Abstract (EN)
Paternity is regulated under the title of "kinship" in the Family Law book of our Turkish Civil Code. Unlike the abrogated Civil Code No. 743, the qualifications that constitute discrimination for the child in the form of an illegitimate child are not included in our Turkish Civil Code and have been abandoned. The concepts of paternity have been included in the Turkish Civil Code No. 4721 with new regulations in accordance with today's conditions. The application of the provisions on paternity regulated between Articles 321- 334 of the Turkish Civil Code depends on the establishment of paternity between the child and his/her parents. In order to establish paternity, blood relation or adoption relationship is required. With the mother, paternity can be established by birth, while with the father it can be established by marriage, recognition and paternity lawsuit. After the establishment of paternity, the way in which paternity is established does not make any difference for the child, but the conditions, provisions, and periods of forfeiture of rights of each way of establishing paternity may differ. In our study, the legal nature, conditions, provisions, relationship and invalidity of recognition, which is one of the ways of establishing paternity, with other ways of establishing paternity will be discussed, and the gaps in the law, opinions in the doctrine and our opinions will be included.
