Abstract (EN)

İn our legislation, the Turkish Code of Obligations and the Turkish Commercial Code were imposed in the near term and the new the Turkish Code of Obligations and the Turkish Commercial Code entered into force. Taking into account the changes made in the related laws and the commercial advantage of the commercial enterprises, it is aimed to collectively deal with the provisions transfer of commercial enterprises. When we look in, a commercial enterprise is defined as a business that keeps its income at a level exceeding the foreseen limit for trades and the activities are carried out continuously and independently. It brings a legal union with the elements of assets brought together by the merchant. It is possible that the business operator may be the subject of a circuit or other legal process as a whole. It was tried to explain the commercial business by comparing its similarities and differences with those of the old regimes with the thought that it would be useful in the transference, theory and practice. In this context, our scheme consists of three main parts. The consequences of the relevant departments regarding the transfer of commercial enterprises are then placed under the heading "RESULT".
