Abstract (EN)
Article 212 of the Turkish Code of Obligations sets forth seller's default in commercial sales and Article 213 regulates methods to calculate buyer's damage. Commercial sales are not defined by law; thus, the meaning thereof is highly controversial. This study, in its first chapter, examines the historical background of the special regulations regarding seller's default in commercial sales and the regulations in today's legal systems. The second chapter points out the results of the seller's default in commercial sales to the extent that those differ from the results regulated under general provisions regarding obligor's default. The purpose of the last chapter is to evaluate concrete and abstract methods to calculate buyer's damage.
