Abstract (EN)

In this study, the mandatory effect of collective labor agreement is examined within the scope of legal regulations and decisions of the Supreme Court. In the first part of the study, general information about the mandatory effect of the collective labor agreement, the scope of the mandatory effect in terms of time, place, person and subject, and the relations between the direct effect and the following effect of the collective labor agreement are explained. The validity of the legal acts contradictory to the collective labor agreement provisions and against the worker is discussed in the second part of the study. In the third part, the issue of the waiver of the rights arising from the collective labor agreement and the validity of the related transactions which caused to waiver of the rights are clarified. Finally, the elimination of the mandatory effect by the parties and the other termination conditions of the mandatory effect of the collective labor agreement and its outcomes are analyzed in the fourth part of the study.
