The management plan in collective structures

This study, titled, "Management Plan in Collective Structures" was prepared as a master thesis at Istanbul University, Institute of Social Sciences. In this study, it has been studied on the collective structure management plan, which is the document of a management contract, in which all issues related to the management of collective structures are regulated. Although the main subject of this study is the management plan in collective structures, in the first section, the concept of collective structure, establishment, and management of the collective structures are explained to understand the difference of the collective structure management plan from the management plan in the classical condominium ownership. In this section, while examining the issues of establishment and management of collective structures, first of all, the situation in the classical condominium ownership is mentioned and our examination was made comparatively between these types of construction. The second part includes the main subject of the study as well as, under the first title the definition, firstly legal nature and bindingness of the collective structure management plan were examined. Under the second title, the preparation of the collective structure management plan by floor owners and the court; under the third title, the change and cancellation of the collective structure management plan are included. In this section where the collective structure management plan is examined, comparisons are made between the management plan of classical condominium ownership and management plan of the collective structures under each title. Under the fourth title of this section, the issue of the adapting management plans of the collective structures established before the amendment of the Law No. 5711 to the provisions of the Condominium Law is also examined.
