Abstract (EN)
Unfair competition, which is one of the two branches of law aiming to protect and preserve the existence of free competition, is intended to prohibit dishonest behavior and commercial practices between competitors and other market participants, unlike competition law, thereby aiming to establish an honest and unspoiled competition regime. Various unfair competition acts have been organized as crimes at the same time in line with this aim and it is envisaged to punish those who execute these acts. Within the scope of this study, the crimes of unfair competition organized in the Turkish Commercial Code 62 / I-b, c, d which are economic crimes at the same time, were analyzed and their elements were determined and controversial points were determined and various solution proposals were tried to be introduced.
